Terms & Conditions

These Terms & Conditions ("Terms") govern access to and use of Desert Place Rentals, a marketplace operated in Las Vegas, Nevada that connects people who own event, photo, and production spaces ("Hosts") with people looking to book them ("Renters"). By creating an account, listing a space, or submitting a booking request, you agree to these Terms. If you don't agree, don't use the platform.

1. What Desert Place Rentals is — and isn't

Desert Place Rentals is a marketplace facilitator. We provide the platform that lets Hosts list spaces and Renters submit booking requests, and we process the associated payments and commission. We are not a party to the rental agreement formed between a Host and a Renter when a booking is approved, we do not own or operate any listed space, and we do not inspect listings for accuracy beyond what a Host represents to us. The contract for the use of a space is between the Host and the Renter directly.

2. Accounts

• You must be at least 18 years old and able to form a binding contract to use Desert Place Rentals.
• You're responsible for the accuracy of your account information and for anything that happens under your login.
• One person, one account — don't create an account on someone else's behalf without their authorization.

3. Listings and hosting

Hosts are solely responsible for the accuracy of their listings (description, photos, pricing, capacity, amenities, and house rules), for holding any permits, licenses, or insurance their jurisdiction or space requires for the activities they allow, and for the condition and safety of the space itself. Desert Place Rentals may remove a listing or suspend a Host account for inaccurate listings, safety concerns, or violations of these Terms or the Community Guidelines.

4. Booking requests, approval, and payment

Bookings on Desert Place Rentals work on a request-to-book basis: a Renter submits a request with a date, time, and guest count, and the Host has a response window (shown on the listing) to approve or decline it. A booking is only confirmed once the Host approves it. Payment is collected through our payment processor once a booking is confirmed, per the pricing breakdown shown to the Renter at request time, which includes the space's rate, any cleaning fee, and our service fee. Cancellations and refunds are governed by the Cancellation Policy and the cancellation policy selected on the individual listing.

5. Fees

We charge Hosts a commission on each completed booking, currently 15% of the booking subtotal, and may charge Renters a separate service fee shown before a request is submitted. Fee terms for Hosts are also set out in the Host Agreement.

6. Prohibited use

• Listing a space you don't have the right to rent out.
• Booking or hosting an event that violates local law, including occupancy limits and noise ordinances.
• Circumventing the platform to avoid fees after a connection was made through Desert Place Rentals.
• Harassment, discrimination, or fraud directed at another user.

7. Disclaimers and limitation of liability

Desert Place Rentals is provided "as is." We don't guarantee that any listing is accurate, available, or suitable for your event, and we're not liable for the condition of a space, the conduct of a Host or Renter, or any loss or damage arising from a booking, to the fullest extent permitted by law. Our aggregate liability to you for any claim arising from these Terms or your use of the platform is limited to the greater of the fees you paid us in the twelve months before the claim, or $100.

8. Governing law and disputes

These Terms are governed by the laws of the State of Nevada, without regard to conflict-of-law rules. Any dispute arising from these Terms or use of Desert Place Rentals will be resolved in the state or federal courts located in Clark County, Nevada, and you consent to that jurisdiction.

9. Changes to these Terms

We may update these Terms from time to time. If we make a material change, we'll post the updated Terms here with a new "Last updated" date and, where required, notify account holders directly. Continued use of the platform after a change takes effect means you accept the updated Terms.
